These AI Terms supplement the Viewst Terms of Use for features identified by Viewst as artificial intelligence features, including generation, translation, background removal and other AI-assisted creative functions (“AI Features”). They apply when accepted as part of your agreement with Viewst. They do not independently amend a signed customer agreement. A signed AI exhibit governing the same features controls over this public page.

1 Access and entitlements

AI Features are optional, subject to your plan and the permissions provided through the Service. You must be at least 18 years old. You are responsible for authorizing your users and their AI submissions. Availability may depend on region, provider, language and technical limits. Your Order governs purchased allowances; use of an AI Feature does not itself authorize extra charges.

2 Inputs outputs and rights

“Input” means a prompt, file or other material you submit to an AI Feature. “Output” means the result returned to you. Both are Customer Content under the Terms of Use. You retain your rights in Inputs. As between you and Viewst, you own Outputs to the extent applicable rights exist, and Viewst assigns to you any transferable rights it holds in those Outputs, excluding underlying Viewst technology and third-party materials.

An Output may resemble existing works or results generated for others. We do not guarantee uniqueness, copyright protection, trademark availability or freedom from third-party claims. Ownership language does not create rights the law does not recognize. Rights in stock content, uploaded materials and other licensed components remain governed by their applicable licenses. AI modification does not eliminate those restrictions.

3 Your review and responsibilities

You must have the rights, lawful basis and permissions needed to submit Inputs and obtain the requested processing. Before publishing or relying on Output, review it for accuracy, legality, suitability, brand consistency and applicable intellectual property, likeness, advertising and accessibility requirements. Obtain professional advice where your use requires it. Viewst does not approve your advertising claims or warrant campaign performance.

Outputs may be incorrect, biased, incomplete, inappropriate or resemble protected materials. Do not rely on AI Features for emergency services, safety-critical decisions, or professional advice without qualified human involvement. Do not use them to make solely automated decisions with legal or similarly significant effects on individuals.

The Terms of Use acceptable-use and restricted-data rules apply. Do not create unlawful impersonations, fraudulent endorsements, nonconsensual intimate content, child sexual exploitation material, or other prohibited content; bypass safeguards; or misrepresent AI-generated material where that would deceive others or violate law. Preserve authenticity or provenance information where required by law or the applicable material’s license, and make any legally required AI disclosures.

4 Processing and providers

We may send Inputs and necessary context to AI providers acting on our behalf to supply the feature you request. Providers may process and retain submissions for that purpose and for disclosed security or abuse prevention, subject to our agreement and applicable law. Human access may occur where necessary for support or security under appropriate protections. We do not promise zero retention or a particular processing country merely because a feature is described as AI.

Before enabling a feature, we will make available information identifying its material AI providers and relevant processing, retention and human-review conditions. Contact hello@viewst.com for that information and any required DPA before submitting personal data. We remain responsible for providers’ performance of our obligations; using a provider does not authorize it to disregard contractual restrictions.

5 Model training requires separate permission

Viewst will not use, or permit its AI providers to use, your Customer Content to train or fine-tune shared or general-purpose models without a separate, affirmative opt-in from you or your organization’s authorized representative. Using an AI Feature, providing feedback, accepting these Terms, or sharing a design does not constitute that opt-in. An individual user cannot override an organization’s signed no-training agreement.

Any proposed opt-in must identify the content, purpose, participating providers, duration, withdrawal method, and the effect of withdrawal on prior training. No opt-in is implied by an undocumented setting or a default toggle. Without that permission, processing is limited to providing, securing and supporting the requested feature and other expressly agreed purposes. Security retention cannot be used to circumvent this restriction. If we cannot provide a feature consistently with these commitments, we will not enable it under these terms unless a separate lawful agreement resolves the difference.

6 Limits changes and discontinuation

AI usage may be metered. Allowances, units and reset or expiry periods must be disclosed in your Order or the applicable purchase information. Different operations may consume different amounts only on a disclosed basis. We may pause a feature at its allowance or apply proportionate restrictions for abuse, legal compliance or technical protection. Additional paid usage requires authorization. There is no guarantee that every permitted request will return a usable result.

We may replace a provider or model or restrict unsafe requests. We will give notice of material processing changes where required by the agreement or law and will not expand training rights through a provider change. Purchased core functionality and any applicable refund rights remain governed by the Terms of Use; beta functionality has no independent production commitment.

7 Warranties liability and signed agreements

AI Outputs are subject to the disclaimers in Section 18 of the Terms of Use. Viewst gives no separate warranty of output accuracy, fitness, uniqueness, copyrightability or noninfringement and no public-plan AI-output indemnity. This does not negate express content-processing, confidentiality, security or no-training commitments.

Sections 18 through 21 of the Terms of Use govern indemnification, liability limits, mandatory rights and disputes for AI Features. These AI Terms create no separate liability cap or uncapped indemnity. They control AI-specific details only; they do not override the Terms of Use liability provisions or a signed enterprise agreement. Changes follow Section 22 of the Terms of Use and cannot retroactively expand training consent.
